Privacy policy and cookie policy
We respect the right to privacy and protection of personal data of the Users of our website and online shop available at https://www.indigo-nails.com/ (hereinafter referred to as: the Website). This Privacy Policy sets out the principles on which we collect and process personal data of our Users.
§ 1. Personal data
In accordance with the definition set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the GDPR, ‘personal data’ means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
§ 2. Controller of personal data
The Controller of Users’ personal data is INDIGO NAILS spółka z ograniczoną odpowiedzialnością with its registered office in Łódź at ul. Senatorska 14/16, 93-192 Łódź, Poland, entered in the Register of Entrepreneurs kept by the District Court for Łódź-Śródmieście in Łódź, 20th Commercial Division of the National Court Register, under the KRS number: 0001099337, holder of the following VAT number: 7272792881 and National Official Business Register number (REGON): 528319750.
§ 3. Collection of personal data
- Personal data is collected by us during the process of:
1) subscribing to the newsletter;
2) setting up an account on the Website;
3) placing orders (for Users who do not have an account on the Website).
- When subscribing to the newsletter, we collect the following personal data: e-mail address.
- When completing the account registration form, we collect the following personal data: first name, surname, e-mail address, telephone number and address for the issue of invoices.
- When placing orders by Users who do not have an account on the Website, we collect the following personal data: first name, surname, e-mail, telephone number, and address for shipment of goods.
§ 4. Purpose of personal data collection
- Personal data collected when subscribing to the newsletter is collected for the purpose of conducting marketing activities towards Users, including for analytical and statistical purposes.
- Personal data collected when setting up an account on the Website is processed for the purpose of:
- concluding and implementing a contract for the provision of electronic services, i.e. enabling the User to use our Website;
- concluding and implementing a contract of sale (distance), the subject of which are goods available in our online shop;
- investigating and examining complaints that may be made in connection with the purchase of goods in our online shop;
- asserting or defending against claims arising as a result of the conclusion of the aforementioned contracts;
- marketing of products and services, including for analytical and statistical purposes;
- contacting Users, including for purposes related to permitted marketing activities, through available channels of communication, in particular and with the consent of Users – by e-mail and telephone;
- Personal data collected when placing orders is processed for the purpose of:
- concluding and implementing a contract for the provision of electronic services, i.e. enabling the User to use our Website;
- concluding and implementing a contract of sale (distance), the subject of which are goods available in our online shop;
- investigating and examining complaints that may be made in connection with the purchase of goods in our shop;
- asserting or defending against claims arising as a result of the conclusion of the aforementioned contracts;
- marketing of products and services, including for analytical and statistical purposes;

§ 5. Entrusting the processing and sharing of personal data
- Users’ personal data collected by us may be transferred on the basis of a personal data processing agreement to entities supporting us in concluding and performing the contracts referred to above, as well as in asserting or defending against claims, in carrying out obligations arising from the provisions of law, and also supporting us in providing marketing services, including in particular: entities providing advisory, consulting, audit, legal, tax, and accounting assistance, research agencies operating on our behalf, Poczta Polska (Polish Post), courier companies, IT service providers, marketing agencies, as well as to entities associated with us personally or by capital, and our business partners.
- With the User’s consent, his/her personal data may be shared with our affiliates and our business partners for the purpose of direct marketing of their products and services.
§ 6. Users’ rights in respect of data processing
- The User is entitled to access the content of his/her data and to correct it, remove it or restrict its processing.
- To the extent that the basis for personal data processing is the implementation of a contract or User’s consent – the User has the right to transfer the provided personal data to another controller.
- To the extent that the basis for data processing is the legitimate interest of the Controller – the User has the right, at any time, to object to the processing of his/her personal data.
- In order to exercise the rights referred to in paragraphs 1-3, the User should contact the Data Protection Officer appointed by the Controller by e-mail at [email protected] or by letter to the address of the Controller’s registered office indicated above.
- Furthermore, the User has the right to lodge a complaint with the supervisory authority in charge of personal data protection.
§ 7. Cookies
Cookies are small text information in the form of text files, sent by a server and stored in the end device of Users visiting the website https://www.indigo-nails.com/ (e.g. on a hard drive of a computer, laptop, or on a smartphone memory card – depending on the device used by the User).
We use our own session and persistent cookies on the website https://www.indigo-nails.com/. Our own cookies are used to: keep the User’s shopping cart and session; remember the language version and country of delivery; remember the reference code (from where the customer accessed the website); remember the data entered in the order form – method of delivery and payment, delivery address and billing address; remember the User’s preferences, e.g. sorting settings, whether to display certain messages again, etc.
We also use external cookies from entities we collaborate with, such as Google and Facebook. We also use Tracking pixels (or Web bugs), which have a similar function to cookies, but are unrecognisable to the User. Tracking pixels are used by us to measure the User’s behaviour on the website, to send newsletters or to match offers in remarketing advertising. The data is anonymous and is not linked to personal data on the User’s end device or any database. In order to disable Web bug while using our website, we recommend using tools such as webwasher, bugnosys or AdBlock (for Firefox browser). In order to disable Web bug in the newsletter, we recommend changing the settings of the e-mail client so that it does not display messages in html. Additionally, Web bug does not work when messages are read off-line.
